Ponyicki v Sawayama

Ponyicki v Sawayama

Ponyicki v Sawayama, [1943] SCR 197
This is an appeal from Ponyicki v Sawayama (58 B.C.R. 299). The plaintiff appealed to increase the amount of money given to him as compensation following the death of his wife in a motor accident, struck by a vehicle being driven by one of the defendants. The Justices ultimately dismissed the appeal, citing a lack of evidence of pecuniary loss exceeding what the trial judge had already awarded in damages.

Terminology

Readers of these historical materials will encounter derogatory references to Japanese Canadians and euphemisms used to obscure the intent and impacts of the internment and dispossession. While these are important realities of the history, the Landscapes of Injustice Research Collective urges users to carefully consider their own terminological choices in writing and speaking about this topic today as we confront past injustice. See our statement on terminology, and related sources here.
