Municipal Elections Act (Re)
Re Municipal Elections Act, [1912] 2 DLR 349
Several unnamed voters were struck from the list of voters by a court of revision,
on the basis that they had made an affadvait before the wrong type of commissioner.
The voters complained that the court lacked the authority to strike voters, or alternatively
that the commissioner they were in front of was sufficient. Justice Gregory rejected
the first argument on the basis that it undermined the purpose of the statute, and
the second argument on the basis that the connection between the commissioners was
too tenuous to regard them as being equivalent.
