Young v Uchiyama, [1933] 48 BCR 55
The judgement of Judge Fisher is appealed, with G.M. Sloan standing for the defendant/appellant
and C.W. Tysoe representing the plaintiff/respondent. Chief Justice Macdonald recommended
dismissing the appeal; so did Justices Martin, McPhillips, and M.A. Macdonald. It
is determined that the discharge of Takagishi on a nolle prosequi constituted a “judgement
for the defendant,” entitling the accused to “recover from the prosecutor the costs
incurred by him by reason of such indictment or information.”
